Terms & conditions for photo shoots

The following terms and conditions constitute an agreement between the parties photographer (“photographer.cologne”, artist name: “Alex Pivo”, hereinafter referred to as “photographer”) and the model.

This is intended to help with the planning and coordination between the photographer and model in the run-up to a shoot and to prevent misunderstandings.

By bindingly confirming the shoot, the model accepts these terms and conditions. In addition, the photographer asks the model for a short confirmation in text form that this agreement has been read and understood, in particular the cancellation policy listed down below.

Pay-Shoot (photographer pays model)

  1. The model is paid a fee to be agreed and, if applicable, travelling expenses. This covers all claims.
  2. Unless otherwise agreed, the method of payment is PayPal, Revolut or bank transfer.
  3. The model has no further claim to the content produced (photos or videos). The photographer may provide the model with any photos or videos, but is not obliged to do so as the model has already been paid.
  4. The model authorises the photographer to use and publish the content without any time or space restrictions.
  5. The naming of the model is at the discretion of the photographer.

Pay-Shoot (model pays photographer)

  1. The Photographer is paid a fee to be agreed and, if applicable, travelling expenses. This covers all claims.
  2. After the shoot, the photographer will provide the model with an online preview link where the model can review the photos and select her favourites. The final selection of photos is at the model’s discretion.
  3. The photographer will hand over the edited photos within 2 weeks, or videos within 8 weeks, after the selection of favourites.
  4. The photographer authorises the model to use and publish the photos taken without any time or space restrictions.
  5. The naming of the photographer is at the discretion of the model.

TFP-Shoot

  1. Photographer and model both perform the shoot free of charge. Neither party receives a fee.
  2. After the shoot, the photographer will provide the model with an online preview link where the model can review the photos and select her favourites. The photographer also selects his favourite shots. The final selection of photos is at the discretion of the photographer.
  3. The type, style, strength etc. of the image processing is at the photographer’s discretion, taking into account the model’s interests.
  4. The photographer will edit a number of images appropriate to the shooting time and hand over them to the model in high resolution for download via a shared cloud folder. An exact number is not specified and may have to be agreed bilaterally.
  5. The photographer shall hand over the edited photos within 2 weeks, or videos within 8 weeks, after the selection of favourites.
  6. Both parties authorise each other to use and publish the photographs taken without any time or space restrictions.
  7. Both parties undertake to mention each other’s names in publications and to tag and mark each other on social media.

  1. In case – after the shoot has already been agreed – the model makes significant changes to her appearance (e.g. change of hair color or hairstyle, new tattoos, breast enlargement, Brazilian butt lift, etc.), the photographer reserves the right to extraordinary cancellation of the shoot.
  2. In this case, the conditions of the “Cancellation Policy” apply (see below).
  3. The photographer will not pay the model a fee or travel expenses.

  1. In case – after the shoot has already been agreed – the model changes her mind regarding her workimg levels (shoot levels, genres), the photographer reserves the right to extraordinary cancellation of the shoot.
    For example: a nude shoot was agreed, but the model no longer wants to shoot nude on the day of the shoot.
  2. In this case, the conditions of the “Cancellation Policy” apply (see below).
  3. The photographer will not pay the model a fee or travel expenses.

  1. The shooting time begins when the model is ready and ends after the agreed duration.
    For example: a shoot is agreed for 2 hours from 4 to 6 pm, but the model is late or the model has to finish her phone call so that the shoot can actual start at 4:15 pm, the shoot either lasts until 6:15 pm (= 2 hours) or it ends at 6 pm and the model fee is reduced proportionately.
  2. The photographer expects the model to have applied the agreed make-up and styling in advance. If this is not possible, please speak.
  3. Choosing outfits, changing times, coordinating sets and ideas are all part of the overall shooting time.
  4. The model can ask for a break at any time, be it to drink, take a deep breath, stretch the body or go to the bathroom.
  5. If the photographer picks up the model at the train station or airport, the travel time does not count as shooting time. The shooting time begins: see first bullet point

  1. If the model arrives up to 15 minutes late for the agreed shoot, the fee will automatically be proportionately reduced.
  2. In the case of delays of more than 15 minutes
    1. without notification/message/phone call: the photographer considers the shoot to be canceled and the cancellation conditions apply.
    2. with notification/call: it is at the discretion of the photographer to still proceed with the shoot or to cancel it. The conditions (duration of the shoot, fee) must be re-agreed at this time.

  1. Under no circumstances may the photographer be included in so-called backstage / behind-the-scenes / making-of photos or videos.
    Also not parts of the body, e.g. from behind, back, arms etc.
    Plain and simple: not at all.
  2. The model is of course allowed to take selfies or place her phone to film or live stream herself during the shoot. But please be aware of bullet point 1.
  3. The model is not permitted to take pictures of the photographer’s camera display.

The following conditions apply to any type of shoot, whether it’s TFP or paid:

Agreements made verbally, by email, WhatsApp, Instagram, etc. are legally binding and already constitute a contract.

This means that, in particular, agreements regarding the time and location of a photo shoot must be adhered to.

The model shall be liable for compensation if she fails to fulfil this obligation and fails to appear on the agreed date. The compensation can be relatively high, especially in the case of a shooting trip.

In case of a no-show or cancellation of the shoot by the model:

  1. A cancellation fee of 200 € per agreed shooting hour plus a fixed fee of 500 € (e.g. for organisation and planning, travel expenses, location rental) will be charged to the model.
  2. If other persons/service suppliers are involved who also have to be paid whether the model appears or not (e.g. make-up artist, stylist, assistant, other models, agency, catering, or similar), these costs will also be passed on 1:1 to the model.
  3. If the photographer has paid for the model’s travel expenses, train or flight tickets, etc. in advance, the model must also repay these costs in full.

The time of the cancellation is irrelevant, as it is no longer possible to adequately reschedule shootings, especially in other cities or abroad.

Cancellation policy

The following conditions apply to any type of shoot, whether it’s TFP or paid:

Agreements made verbally, by email, WhatsApp, Instagram, etc. are legally binding and already constitute a contract.

This means that, in particular, agreements regarding the time and location of a photo shoot must be adhered to.

The model shall be liable for compensation if she fails to fulfil this obligation and fails to appear on the agreed date. The compensation can be relatively high, especially in the case of a shooting trip.

In case of a no-show or cancellation of the shoot by the model:

  1. A cancellation fee of 200 € per agreed shooting hour plus a fixed fee of 500 € (e.g. for organisation and planning, travel expenses, location rental) will be charged to the model.
  2. If other persons/service suppliers are involved who also have to be paid whether the model appears or not (e.g. make-up artist, stylist, assistant, other models, agency, catering, or similar), these costs will also be passed on 1:1 to the model.
  3. If the photographer has paid for the model’s travel expenses, train or flight tickets, etc. in advance, the model must also repay these costs in full.

The time of the cancellation is irrelevant, as it is no longer possible to adequately reschedule shootings, especially in other cities or abroad.

Confirmation and required information before the shoot

Please confirm to me briefly in text form (where we are already writing, e.g. e-mail, WhatsApp, Instagram, Facebook, Model-Kartei, Modelmayhem, Purpleport, etc.) that you have noticed and understood these terms and conditions.

Unfortunately, I cannot confirm the shoot without explicit acknowledgement of this information.

Shooting-Vereinbarung

Die folgenden Bedingungen stellen eine Vereinbarung zwischen den Parteien Fotograf („photographer.cologne“, Künstlername: „Alex Pivo“, nachfolgend „Fotograf“ genannt) und dem Model dar.

Dies soll im Vorfeld eines Shootings bei der Planung und Abstimmung zwischen dem Fotografen und Model helfen und Missverständnissen vorbeugen.

Durch eine verbindliche Bestätigung des Shootings erkennt das Model diese Bedingungen an. Darüber hinaus bittet der Fotograf das Model um eine kurze Bestätigung in Textform, dass diese Vereinbarung gelesen und verstanden wurde, insb. die weiter unten aufgeführte Cancellation Policy.

Pay-Shooting (Fotograf bezahlt Model)

  1. Das Model erhält einen zu vereinbarenden Geldbetrag als Honorar und ggf. Reisekosten. Damit sind alle Ansprüche abgegolten.
  2. Als Zahlungsweise gilt, sofern nicht anders vereinbart: PayPal, Revolut oder Banküberweisung.
  3. Das Model hat darüber hinaus keinen Anspruch auf die erstellten Aufnahmen (Fotos oder Videos). Der Fotograf kann dem Model Aufnahmen zur Verfügung stellen, ist dazu aber nicht verpflichtet, da das Model bereits bezahlt wurde.
  4. Das Model gestattet dem Fotografen die Nutzung und Veröffentlichung der erstellten Aufnahmen ohne zeitliche oder räumliche Einschränkung.
  5. Die Namensnennung des Models liegt im Ermessen des Fotografen.

Pay-Shooting (Model bezahlt Fotograf)

  1. Der Fotograf erhält einen zu vereinbarenden Geldbetrag als Honorar und ggf. Reisekosten. Damit sind alle Ansprüche abgegolten.
  2. Nach dem Shooting wird der Fotograf dem Model einen online Vorschaulink zur Verfügung stellen, auf dem das Model die erstellten Aufnahmen anschauen und ihre Favoriten auswählen kann. Die finale Auswahl der Motive steht im Ermessen des Models.
  3. Der Fotograf übergibt die bearbeiteten Fotos innerhalb von 2 Wochen, bzw. Videos innerhalb von 8 Wochen, nach der Favoritenauswahl.
  4. Der Fotograf gestattet dem Model die Nutzung und Veröffentlichung der erstellten Aufnahmen ohne zeitliche oder räumliche Einschränkung.
  5. Die Namensnennung des Fotografen liegt im Ermessen des Models.

TFP-Shooting

  1. Fotograf und Model führen beide das Shooting unentgeltlich durch. Keine Partei erhält ein Honorar.
  2. Nach dem Shooting wird der Fotograf dem Model einen online Vorschaulink zur Verfügung stellen, auf dem das Model die erstellten Aufnahmen anschauen und ihre Favoriten auswählen kann. Der Fotograf wählt ebenso seine favorisierten Aufnahmen. Die finale Auswahl der Motive steht im Ermessen des Fotografen.
  3. Die Art, Stilistik, Stärke etc. der Bildbearbeitung liegt im Ermessen des Fotografen unter Beachtung der Belange des Models.
  4. Der Fotograf bearbeitet eine der Shootingzeit angemessene Anzahl an Aufnahmen und stellt sie dem Model in hoher Auflösung zum Download über einen geteilten Cloud-Ordner zur Verfügung. Eine exakte Anzahl wird nicht genannt und muss ggf. bilateral vereinbart werden.
  5. Der Fotograf übergibt die bearbeiteten Fotos innerhalb von 2 Wochen, bzw. Videos innerhalb von 8 Wochen, nach der Favoritenauswahl.
  6. Beide Parteien gestatten sich gegenseitig die Nutzung und Veröffentlichung der erstellten Aufnahmen ohne zeitliche oder räumliche Einschränkung.
  7. Beide Parteien verpflichten sich zur gegenseitigen Namensnennung bei Veröffentlichung bzw. zur gegenseitigen Markierung und Erwähnung in Social Media.

  1. Für den Fall, dass das Model – nachdem das Shooting bereits vereinbart wurde – wesentliche Änderungen an ihrem Aussehen vornimmt (z.B. Änderung der Haarfarbe oder Frisur, neue Tätowierungen, Brustvergrößerung, Brazilian-Butt-Lift, etc.), behält sich der Fotograf das Recht vor, das Shooting außerordentlich abzusagen.
  2. In diesem Fall gelten die “Stornierungsbedingungen” (siehe unten).
  3. Der Fotograf zahlt dem Model kein Honorar und keine Reisekosten.

  1. Für den Fall, dass das Model – nachdem das Shooting bereits vereinbart wurde – ihre Meinung bezüglich ihrer Arbeitsbereiche (Aufnahmebereiche) ändert, behält sich der Fotograf das Recht vor, das Shooting außerordentlich zu stornieren.
    Beispiel: Es wurde ein Aktshooting vereinbart, aber das Model möchte am Tag des Shootings nicht mehr nackt fotografieren.
  2. In diesem Fall gelten die “Stornierungsbedingungen” (siehe unten).
  3. Der Fotograf zahlt dem Model kein Honorar und keine Reisekosten.

  1. Die Shootingzeit beginnt, wenn das Model bereit ist und endet nach der vereinbarten Dauer.
    Beispiel: Ein Shooting ist für 2 Stunden von 16 bis 18 Uhr vereinbart, aber das Model verspätet sich oder das Model muss ihr Telefonat beenden und das Shooting kann tatsächlich um 16:15 Uhr beginnen, dann dauert das Shooting entweder bis 18:15 Uhr (= 2 Stunden) oder es endet um 18 Uhr und das Modelhonorar wird entsprechend gekürzt.
  2. Der Fotograf erwartet, dass das Model das vereinbarte Make-up und Styling vorher aufgetragen hat. Sollte dies nicht möglich sein, bitte sprechen.
  3. Die Wahl der Outfits, die Umkleidezeiten, die Abstimmung der Sets und Ideen sind Teil der gesamten Shootingzeit.
  4. Das Model kann jederzeit um eine Pause bitten, sei es, um etwas zu trinken, tief durchzuatmen, sich zu strecken oder auf die Toilette zu gehen.
  5. Wenn der Fotograf das Model am Bahnhof oder Flughafen abholt, zählt die Fahrtzeit nicht als Shootingzeit. Die Aufnahmezeit beginnt: siehe erster Punkt

  1. Erscheint das Model bis zu 15 Minuten zu spät zum vereinbarten Shooting, wird das Honorar automatisch anteilig gekürzt.
  2. Bei Verspätungen von mehr als 15 Minuten
    1. ohne Benachrichtigung/Anruf: betrachtet der Fotograf das Shooting als abgesagt und es gelten die Stornobedingungen.
    2. mit Benachrichtigung/Anruf: liegt es im Ermessen des Fotografen, das Shooting noch durchzuführen oder zu stornieren. Die Konditionen (Shooting-Dauer, Gage) müssen zu diesem Zeitpunkt neu vereinbart werden.

  1. Auf keinen Fall darf der Fotograf auf sogenannten Backstage-/Hinter-den-Kulissen-/Making-of-Fotos oder -Videos zu sehen sein.
    Auch nicht Teile des Körpers, z.B. von hinten, Rücken, Arme etc.
    Ganz einfach: gar nicht.
  2. Natürlich darf das Model während des Shootings Selfies machen oder ihr Handy zum Filmen oder Live-Streaming nutzen. Aber bitte Punkt 1 beachten.
  3. Das Model darf nicht das Kameradisplay des Fotografen abfotografieren.

Die folgenden Bedingungen gelten für alle Arten von Shootings, sowohl für TFP als auch für Pay-Shoots.

Mündlich, per E-Mail, Whatsapp, Instagram usw. getroffene Vereinbarungen sind rechtsverbindlich und stellen bereits einen Vertrag dar.

Das bedeutet, dass insbesondere auch Vereinbarungen betreffend Zeit und Ort eines Fotoshootings eingehalten werden müssen.

Das Model macht sich schadensersatzpflichtig, wenn es diese Verpflichtung nicht einhält und etwa zum vereinbarten Termin nicht erscheint. Der Schaden kann insbesondere bei einer Shootingsreise verhältnismäßig hoch ausfallen.

Bei Nichterscheinen oder einer Shootingabsage durch das Model:

  1. Eine Stornogebühr in Höhe von 200 € pro vereinbarter Shootingstunde plus eine Pauschale von 500 € (z. B. für Organisation und Planung, Reisekosten, Locationmiete) wird dem Model berechnet.
  2. Sollten weitere Personen/Dienstleister beteiligt sein, die ebenfalls bezahlt werden müssen, ob das Model erscheint oder nicht (z. B. Make-Up-Artist, Stylist, Assistent, weitere Models, Agentur, Catering o. ä.), werden diese Kosten ebenfalls 1:1 an das Model weiterberechnet.
  3. Hat der Fotograf im Voraus Reisekosten, Zug- oder Flugtickets etc. des Models bezahlt, muss das Model auch diese Kosten in voller Höhe zurückzahlen.

Dabei spielt der Zeitpunkt der Absage keine Rolle, denn insb. bei vereinbarten Shootings in anderen Städten oder im Ausland kann nicht mehr adäquat umgeplant werden.

Ausfallgebühr / Stornierungsbedingungen

Die folgenden Bedingungen gelten für alle Arten von Shootings, sowohl für TFP als auch für Pay-Shoots.

Mündlich, per E-Mail, Whatsapp, Instagram usw. getroffene Vereinbarungen sind rechtsverbindlich und stellen bereits einen Vertrag dar.

Bestätigung und benötigte Infos vor dem Shooting

Bitte bestätige mir kurz in Textform (dort, wo wir gerade sowieso schon schreiben, bspw. E-Mail, WhatsApp, Instagram, Facebook, Model-Kartei, Modelmayhem, Purpleport etc.), dass du diese Informationen wahrgenommen und verstanden hast.

Ohne ausdrückliche Anerkennung dieser Information kann ich das Shooting leider nicht bestätigen.
